Ice on the road or pavement

The highway authority has a duty to take reasonably practicable steps to ensure the road is not dangerous due to snow or ice.  However, that is a qualified obligation which will normally be satisfied by them complying with a strategic plan of gritting.

Where water is deposited on the highway and freezes then whoever is responsible for the water is liable.  In the past this has included a water company being responsible for water from a burst water main and a bus garage being liable for ice caused from washing their buses.  However it would also extend to water from a dripping outside tap.
