Construction Disputes - FAQs About Making a Claim

Who can make a claim?

Anyone who has entered into an agreement with a member of the construction industry to have work performed which has led to a construction dispute. A member of the construction industry could be a builder, architect, engineer or trades-person.

If there is a written contract for the work this may make bringing a claim easier. You can also bring a claim if the agreement for the works was based on a discussion or verbal agreement with the member of the construction industry, but you may have difficulties proving what was agreed.

How does it work?

The circumstances of your dispute will dictate how straightforward or complex your claim will be.

Can I make a claim myself?

The simple answer is yes. If you think the dispute is clear cut you could bring the claim to Court yourself.  However, once you are in the Court process there are possible pitfalls for those who have not brought a claim before or do not have legal training.  We can assist you at all levels, whether helping you draft the papers to send to Court or running the entire claim from woe to go.

I don't want to do it myself. Can I pay someone to help me?

Absolutely.  We can take over and run your claim from start to finish or any stage in between.

What will it cost?

The cost will vary depending on the complexity of the issues and the amount of work which is need to be done.  We assess each case when it is received and provide a costs estimate as early as we can.
